Terms
GearSafe Terms of Use
Effective date: October 16, 2026
These terms are an agreement between you and Quantum Nonsense LLC ("GearSafe", "we", "us") for your use of the GearSafe app and service. By creating an account or using GearSafe you agree to them. If you do not agree, do not use GearSafe. Our Privacy Policy explains how we handle your information.
1. What GearSafe is
GearSafe helps you keep records of music equipment you own: photos, serial numbers, receipts, values and PDF reports built from those records. GearSafe is free to use.
2. What GearSafe is not
- GearSafe is not an insurance company, agent, broker or licensed insurance producer. It does not sell, quote, bind or recommend insurance, coverage, carriers, agents or amounts, and it is not paid by agents or insurers.
- Values are estimates, not appraisals. Suggested values come from listings and retailer prices found within the last 7 days, and the values in your records are your own. They are not appraisals, insurable values or amounts any insurer has agreed to.
- Reports are records you made. A GearSafe report shows the information in your account on the date it was built. GearSafe does not verify that you own the items, that the information is accurate, or that any insurer, police force or other party will accept a report. The SHA-256 fingerprint we record for each report file lets a copy be compared with the original; it is not a certification of the contents.
3. Your account
- You must be at least 18 years old to use GearSafe.
- Give accurate account information, keep your password private, and tell us at support@yourgearsafe.com if you think someone else has used your account. You are responsible for activity under your account.
- One person per account. Do not create an account for someone else without their permission.
4. Your content
- You keep ownership of everything you add to GearSafe: photos, documents, records and reports ("your content").
- You give us a limited licence to store, copy, process and display your content only to run GearSafe for you, including sending it to the service providers listed in the Privacy Policy for the features you use, and to carry out any sharing you choose.
- Only add content you have the right to add. Do not add other people's personal information without their permission.
- You can export or delete your content at any time from More → Your data.
5. Acceptable use
Do not:
- use GearSafe for anything unlawful, including recording stolen property as your own or creating false records for an insurance claim;
- try to access other people's accounts or data, or test, probe or bypass GearSafe's security;
- interfere with the service, overload it, or get around fair-use limits;
- scrape, copy or resell the service or its data, or reverse engineer it except as the law allows;
- upload malware or content that infringes someone else's rights.
We may suspend or close an account that breaks these rules.
6. Insurance agent directory
GearSafe includes an optional directory of licensed insurance agents. Sharing with agents opens only after a regulatory review; until then the directory can be browsed but nothing can be shared.
- Agents are listed in alphabetical order. A listing shows the information the agent provided and the licence details GearSafe checked against public records on the date shown. A listing is not a recommendation or endorsement.
- Nothing is sent to an agent unless you choose that agent and agree on the sharing screen. What happens after that, including any quote, advice or policy, is between you and the agent or insurer. GearSafe is not a party to it and is not responsible for it.
- You can revoke an agent's access in the app at any time. Anything the agent already downloaded stays with them.
- To report a listing, use "Report this listing" on the agent's page or email support@yourgearsafe.com.
- Agents who list themselves also agree to the GearSafe agent terms shown during agent sign-up.
7. Third-party services and content
GearSafe shows information from other services, such as eBay listings and retailer prices, and opens links to their websites. That information belongs to its owners, can be incomplete or out of date, and is provided as is. Your use of other websites is governed by their own terms.
8. Changes and availability
We may change, add or remove features, and we may stop offering GearSafe. If we plan to shut down the service we will give you at least 30 days' notice in the app so you can export your data. We may update these terms; if a change is significant we will tell you in the app before it applies. Continuing to use GearSafe after that means you accept the updated terms.
9. Ending your use
You can stop using GearSafe and delete your account at any time from More → Your data. We may suspend or close your account if you break these terms or if we must by law, and we will tell you unless the law prevents it.
10. Disclaimers
GearSafe is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement, and we do not promise that GearSafe will be uninterrupted, error-free or that data will never be lost. Keep your own copies of anything important. The export in More → Your data gives you a copy of your records; photos, report PDFs and full serial numbers are not included, so keep your own copies of those.
11. Limitation of liability
To the fullest extent the law allows, GearSafe and Quantum Nonsense LLC are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or any loss arising from an insurance claim, a valuation, or an agent's or insurer's acts or omissions. Our total liability for any claim about GearSafe is limited to US $50. Some places do not allow these limits, so they may not apply to you.
12. Governing law
These terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Colorado, unless the law where you live gives you the right to bring it locally.
Nothing in these terms takes away rights you have as a consumer under the law of the country where you live that cannot be changed by contract. If you live in the European Economic Area, the United Kingdom or Switzerland, sections 10 and 11 do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that law does not allow us to limit.
13. Apple
If you downloaded GearSafe from the App Store:
- These terms are between you and us, not Apple. Apple is not responsible for GearSafe or its content.
- Apple has no obligation to provide maintenance or support for GearSafe.
- If GearSafe fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for GearSafe.
- Apple is not responsible for any claims about GearSafe, including product liability claims, claims that GearSafe fails to meet a legal or regulatory requirement, consumer protection claims, or intellectual property infringement claims. We are responsible for those to the extent these terms do not disclaim them.
- You confirm that you are not located in a country subject to a U.S. government embargo or listed as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
- Apple's Standard Licensed Application End User License Agreement also applies; where it conflicts with these terms, these terms apply to the extent the law allows.
